Sinio is an online platform designed to help creators present their most recent and relevant projects, links and media in one place. We believe in keeping things straightforward, so these Terms & Conditions (the "Terms") aim to explain — in plain language — the rules that apply when you use any part of Sinio (the "Platform"). By accessing the Platform you agree to follow these Terms as well as any policies referenced in them. If you have questions, reach out to us at contact@sinio.io.
Throughout these Terms the expressions "Sinio", "we", "us" or "our" refer to Tristan Heyne. "You" or "your" refers to any individual or organisation that creates an account or otherwise uses the Platform. If you do not agree to every part of these Terms you must stop using the Platform.
The internet never stands still and neither does Sinio. From time to time we may revise these Terms or introduce new features. Any change will be published on this page and will become effective when posted, unless we specify a later date. Where a revision could reasonably have a negative impact on you we will attempt to give at least 30 days' notice via the Platform or email. Your continued use of the Platform after updated Terms have been posted means you accept the modifications. If you do not agree, please discontinue your use of Sinio.
You must be at least 18 years old, or the age of majority in your jurisdiction, to open an account. If you create an account on behalf of another person or entity you confirm that you have the authority to do so and that they are bound by these Terms.
You are responsible for everything that happens through your account, so keep your login credentials secure. Let us know immediately at the email above if you suspect unauthorised use. You may not transfer your account to anyone else without our prior written permission.
If laws in your country (for example, Germany's Telemedia Act) or in any jurisdiction where your profile is accessible require you to provide an Impressum or other mandatory information, it is solely your responsibility to keep that information visible, current and complete. Sinio does not supply legal wording for such notices and is not liable for missing or inaccurate statements on your profile.
Choose a username you have the right to use and that is appropriate for all audiences. Usernames that infringe trademark or personality rights, or which are abusive, deceptive or intended for resale, may be reclaimed by Sinio. If a dispute arises we may request documentation proving your right to the name and may suspend or reassign the username if proof is not provided.
"Content" means any files, text, graphics, links, code, audio, video, or other material you upload, stream, post or otherwise display on the Platform. You represent and warrant that:
You are solely responsible for backing up your Content and for any consequences arising from making it public. Sinio does not actively monitor Content but reserves the right to remove or restrict access to any material that, in our view, breaches these Terms or the law.
By posting Content on the Platform you grant Sinio a worldwide, non-exclusive, royalty-free, transferable and perpetual licence to host, store, reproduce, adapt, publish, display and distribute the Content for the purpose of operating, promoting and improving the Platform. Where your Content contains your name, likeness or other personal attributes you also grant us permission to use those attributes in connection with the Content. You retain ownership of your Content.
Apart from your own Content, all software, designs, trademarks and other materials on the Platform ("Sinio IP") belong to Sinio or our licensors. You receive a limited, revocable, non-exclusive and non-transferable licence to use the Platform solely to create and display your profile and to view other users' profiles in accordance with these Terms. You may not copy, modify, reverse engineer or otherwise exploit Sinio IP without prior written consent.
People who view your profile or interact with your Content are called "End Users". You alone are responsible for dealings with your End Users and for complying with any laws that apply to those interactions (for example, consumer-protection, e-commerce or data- protection regulations). Sinio is not a party to transactions or communications between you and End Users.
We welcome suggestions on how to improve Sinio. If you choose to send feedback you agree that we may use it without restriction or obligation to compensate you. Occasionally we release beta features for testing; such features may be unstable and are provided "as is".
Our Privacy Policy explains how we collect, use and safeguard personal data. By using the Platform you acknowledge that policy and any data-processing terms that apply in your jurisdiction.
If we share non-public information with you (for example, unreleased features) you must keep it confidential and use it only for the purpose for which it was shared, unless we give written permission to disclose it.
The Platform may suggest links or media that could interest you or your audience. Suggestions are generated algorithmically and do not constitute endorsements by Sinio.
The Platform is provided "as is" and "as available". To the fullest extent permitted by law, Sinio disclaims all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not guarantee that the Platform will be uninterrupted, secure or error-free.
To the maximum extent allowed by law, Sinio will not be liable for any indirect, incidental, special, consequential or punitive damages (including lost profits, data, goodwill or business opportunities) arising out of or related to your use of the Platform, even if we have been advised of the possibility of such damages. Our total liability in any 12-month period is limited to the greater of 100 US dollars or the amount you have paid us, if any, during that period.
Sinio may integrate or link to services provided by others (for example, video hosts or analytics tools). Your use of those services is governed solely by the third party's terms. We are not responsible for third-party services and any dispute arising from them is between you and the third party.
These Terms are governed by the laws of Victoria and the Commonwealth of Australia, without regard to conflict-of-law rules. Any dispute arising under the Terms shall be submitted to the exclusive jurisdiction of the courts located there. If a provision of the Terms is found unenforceable, the remaining provisions will remain in full force.
Failure by Sinio to enforce a provision is not a waiver of that provision. These Terms constitute the entire agreement between you and Sinio concerning the Platform and supersede any prior agreements.
